America’s Cup, la Société Nautique de Genève si oppone alla denuncia per oltraggio

America’s Cup – Ginevra – Lo Yacht Club Defender della 33a America’s Cup ha presentato ieri un’opposizione all’ultima strategia legale del Challenger of Record, il Golden Gate Yacht Club. La Société Nautique de Genève sostiene che la mozione per oltraggio è: “nel migliore dei casi prematura e si rivela almeno apparentemente una trovata pubblicitaria di basso spessore. Nella parte iniziale della denuncia, il GGYC respinge gli sforzi fatti dalla SNG per aprire un dialogo sulla corretta data dell’evento e stravolge le intenzioni della Corte d’Appello che sostiene: “il diritto di agire come fiduciario dell’America’s Cup dovrebbe essere conquistato in acqua e non in un’aula di giustizia”.
Durante il meeting del 23 aprile a Ginevra, la SNG ha dichiarato che in seguito alla sentenza del 7 aprile e a quanto sancito nel Deed of Gift, la 33a America’s Cup deve necessariamente svolgersi a a partire dal 3 Maggio 2010. Nessuno dei diversi rappresentanti del GGYC ha protestato, ne in nessun modo il GGYC ha suggerito che la regate si dovesse svolgere a febbraio. In realtà i rappresentanti del GGYC si sono rifiutati di discutere l’argomento in toto, lasciando intendere che avrebbero preferito trattare la questione durante l’incontro successivo. La SNG ha assecondato questa volontà, confidando nella buona fede del GGYC. Il 27 aprile, invece di proseguire nel dialogo, il GGYC ha presentato l’appello alla Suprema Corte di New York.
Entrambe le parti sono attese presso la corte Giovedì 14 Maggio. Il giudice ascolterà la denuncia per oltraggio riguardante la data della regata, e la questione tuttora pendente del Custom-House Registry del GGYC.

SOCIETE NAUTIQUE DE GENEVE FILES OPPOSITION PAPERS TO GOLDEN GATE MOTION FOR CONTEMPT
[Alinghi Source] The 33rd America’s Cup defending yacht club yesterday submitted opposition papers to the latest legal strategy from the Challenger of Record, the Golden Gate Yacht Club. The Société Nautique de Genève declares the Golden Gate Yacht Club’s motion for contempt to be ‘at best premature and appears, on the face of it, to be a cheap publicity stunt. In bringing this motion, Golden Gate Yacht Club rebuffed SNG’s efforts to engage in discussions about the proper race date, and violated the desire of the Court of Appeals that “the right to act as trustee of the America’s Cup should be decided on the water and not in a courtroom”.’
At a 23 April meeting in Geneva, Société Nautique de Genève representatives stated their understanding that under the 7 April court order and the Deed of Gift, the 33rd America’s Cup race needed to be held beginning 3 May 2010. Not one of the multiple Golden Gate Yacht Club representatives uttered a word in protest. Nor did Golden Gate Yacht Club suggest in any way that the race should be held in February, In fact, Golden Gate Yacht Club reps. refused to discuss the topic at all. Instead they made it clear that they preferred to discuss the issue at a later meeting. Société Nautique de Genève took this offer to continue discussions as an honest one. On 27 April, rather than continuing the dialogue the Golden Gate Yacht Club filed this application to the New York Supreme Court.
Both parties are expected in court on Thursday 14 May. The Judge will hear the issue of contempt regarding the date of the next Match and the issue of the ‘pending’ Golden Gate Yacht Club Custom-House Registry.
