America’s Cup, il Golden Gate Yacht Club scrive alla Société Nautique de Genève

[singlepic id=3579 w=204 h=300 float=left]America’s Cup – San Francisco – Mancano pochi giorni alla data stabilita da Alinghi per svelare la località scelta per difendere la Coppa America e dalle parti di BMW Oracle Racing si vuol far chiarezza. Il Golden Gate Yacht Club ha infatti inviati alla Société Nautique de Genève l’ennesima lettera che, al tirar delle somme, non aggiunge niente di nuovo alla querelle in atto ormai da un paio d’anni. In pratica gli statunitensi sottolineano che se Alinghi dovesse scegliere una località dell’emisfero nord diversa da Valencia muoverebbero nuovamente causa davanti alla Corte Suprema dello Stato di New York.
“L’obiettivo di questa lettera – si legge nella missiva indirizzata al vice Commodoro della Société Nautique de Gèneve, Fred Meyer, dal Commodoro del Golden Gate Yacht Club, Marcus Young – è di farvi presente ancora una volta che se doveste scegliere in modo unilaterale una località dell’emisfero nord diversa da Valencia sarà nostra intenzione difendere i nostri diritti ai sensi del Dee of Gift e della sentenza della Corte d’Appello… Giustamente, il Giudice Kornreich con la sua decisione di maggio non ha fatto altro che rinforzare quando stabilito dalla Corte di Appello e dal Deed of Gift e cioè che per scegliere una qualsiasi località diversa da Valencia è necessario il consenso del Golden Gate Yacht Club… E’ ironico che solo due mesi fa, nelle vostre carte rocessuali dell’11 maggio, foste d’accordo con noi, affermando che: ‘Il Deed of Gift non è interpretabile quando proibisce la disputa di match nell’emisfero nord tra l’1 novembre e l’1 maggio…’. Se volete scegliere una localit diversa nell’emisfero nord restiamo disponibili a diuscuterne con voi…”.

Dear Vice Commodore Meyer,
we note that Mr Ostrager’s most recent letter to the court is published on your website.
The purpose of this letter is to put you on notice, yet again, that if you unilaterally select a Northern Hemisphere venue other than Valencia we intend to defend our rights under the Deed and the Order and Judgment of the Court of Appeals. This position has been consistently reiterated to you through correspondence (as recently as July 8, 2009) and public statements. A copy of our July 8th letter, which sets out the substantive basis for our position, is attached to this letter for your reference.
Appropriately, Justice Kornreich’s May decision did no more than enforce the Court of Appeals Order and Judgment and Deed which when read together can only mean that consent by Golden Gate Yacht Club is required for any Northern Hemisphere venue other than Valencia, for a February race. Any other reading of the Deed and Order would result in incongruous and absurd consequences.
It is ironic that just two months ago in your May 11th court papers you agreed with our position, stating that “The Deed of Gift unambiguously prohibits sailing a match between November 1 and May 1 in the Northern Hemisphere… There is nothing in the Order that suggests that a race should be held in contravention of the terms of the Deed of Gift.”
You may of course choose a Southern Hemisphere venue of your choosing for a February race.
If you would like to choose an alternative Northern Hemisphere venue, we are more than willing to discuss proposed venues with you. Absent that, we look forward to your announcement on August 6th of either a Southern Hemisphere venue or Valencia as the venue for the 33rd America’s Cup.
