America’s Cup, il Golden Gate Yacht Club scrive alla Société Nautique de Geneve

[singlepic=2563,204,300,,left]America’s Cup – Valencia – Giunge in redazione una lettera che il Golden Gate Yacht Club ha appena spedito alla Société Nautique de Genève per rispondere alla missiva con la quale lo yacht club defender rispondeva alle dichiarazioni rilasciate dagli statunitensi nel corso della conferenza stampa svoltasi presso la base di BMW Oracle Racing. Di seguito proponiamo una traduzione della stessa:
“Caro Vice Commodoro Fred Meyer,
ti scrivo in rappresentanza del nostro Club, e dei Signori Coutts e Ehman, in risposta alla vostra lettera del 21 maggio 2009.
Prima e dopo la nostra vittoria in Corte d’Appello, la Société Nautique de Genève ha costantemente sostenuto la posizione dichiarata nelle carte processuali, secondo la quale il Deed of Gift proibisce alla stessa di scegliere una località nell’Emisfero Nord in febbraio, data fissata per il match dalla Corte di Appello e con la sentenza del 7 aprile 2009.
La decisione della scorsa settimana non ha, e non poteva, cambiare quanto stabilito dalla Corte di Appello o la sentenza. Piuttosto questa decisione stabilisce che (citato testualmente dai documenti): ”A questo punto sto per emettere la mia decisione. A questo punto, in merito alla richiesta del Goldeg Gate Yacht Club per oltraggio alla Corte, sono a ordinare alla Société Nautique de Genève di disputare le regate come stabilito dalla Corte di Appello”.
Non vediamo nessuna ragione per appellare tale decisione. Ci appare chiaro che voi potete scegliere Valencia per il match di febbraio 2010 o un’altra località che soddisfi il Deed of Gift e ciò, come voi ben sapete, significa soltanto una località nell’emisfero sud.
Ovviamente è possibile sgomberare il campo dai dubbi che voi lamentate nella vostra lettera, annunciando la scelta di Valencia, scelta che avrebbe il nostro supporto. Questa sarebbe in linea con l’annuncio che Ernesto Bertarelli fece al Center for Sports Business Management qui a Valencia il 2 marzo 2009 e più esattamente che Valencia sarebbe stata la località in cui si sarebbe svolta la 33ma Coppa America indipendentemente dalla decisione della Corte di Appello.
Se, nonostante ciò, è vostra intenzione proporre una località nell’emisfero nord differente da Valencia, rimaniamo disponibili per discutere con voi i termini di un accordo in merito. Saremmo disposti ad affrontare queste discussioni immediatamente, per poter rimuovere ogni restante incertezza derivante dalla vostra riluttanza a conformarvi con il chiaro mandato della Corte. Indipendentemente da ciò, non permetteremo al vostro club di imporci termini del match o di reinterpretare il significato del Deed of Gift e della Sentenza.

America’s Cup – Valencia – We publish a letter sent tonight from Golden Gate Yacht Club to Société Nautique de Genève:
“Vice Commodore Fred Meyer
Chairman, America’s Cup Commitee
Société Nautique de Genève
Dear Vice Commodore Meyer,
I write on behalf of our Club, and Messrs. Coutts and Ehman, in response to your letter of May 21, 2009.
Before and after we won in Court of Appeals, SNG has consistently maintained the position in its courts papers that the Deed prohibits SNG from selecting a Northern Hemisphere venue in February, the race date required by mandate of the Court of Appeals and the Aprile 7, 2009 judgment.
The decision last week did not, and could not, change the mandate of the Court of Appeal or the Judgment. Rather, that decision stated (quoted from the court transcript): “I’m just going to issue my decision at this point. At this point, in regard to Golden Gate Yacht Club’s application for contempt, I’m directing SNG to hold the race as pre order of the Court of Appeals.
We see no reason to appeal that decision. It is clear to us that you may select Valencia for the February 2010 match, or an otherwise Deed-compliant venue – which you have acknowledged time and again means only a venue in the Southern Hemisphere.
Of course, you could remove some of the uncertainty that you have created, and of which your letter complains, by announcing that you have selected Valencia, which we would support. That would be consistent with Ernesto Bertarelli’s announcement at the Center for Sports Business Management forum here in Valencia on Marc 2, 2009, i.e, that Valencia would be the venue for the 33rd America’s Cup regardless which way the Court of Appeal ruled.
If, however, it is your intention to propose a Northern Hemisphere location othetr than Valencia, we are willing to discuss with you the therms of an agreement to accomodate this as well. We would be willing to have those discussion immediately to help remove any remaining uncertainty caused by your unwillingness to comply with the Court’s clear mandate. Regardless, we will not permit your club to dictate to us the terms of the match or to reinterpret the meaning of the Deed and the Judgment.
