[singlepic=1353,320,240,,left]America’s Cup – Milano – Dopo la soddisfazione per l’esito della causa espresso da Vincenzo Onorato, patron di Mascalzone Latino, pubblichiamo l’opinione tecnica dell’Avv. Alessandra Pandarese dello Studio Legale Associato Carnelutti:

“La decisione della Corte d’Appello nella sua semplicità ed essenzialità ha salvato la tradizione della Coppa ed ha azzerato regole inaccettabili. Era l’obiettivo primario di questa azione ed è stato raggiunto. Credo che la Coppa, nonostante tutto, ne esca rafforzata: ribadire i saldi principi sul quale si fonda l’evento può portare ad un sano cambiamento. Una sfida sportivamente eccezionale tra due giganti del mare manterrà l’attenzione sulla Coppa, in un momento in cui, realisticamente, non vi sarebbero state risorse per prepararsi degnamente ad un evento multichallengers”.

“In qualità di legale ho assistito Mascalzone Latino intervenendo in giudizio presso la Corte di New York con l’istituto giuridico dell’Amicus Brief a sostegno di BMW Oracle Racing, credendo con fermezza agli obiettivi dell’azione contro Alinghi e contro i suoi piani di trasformare l’America’s Cup in un evento gestito unilateralmente dal Defender e privo del ruolo dei Challengers”.

America’s Cup – Milan – Having noted the satisfaction expressed by Mr. Vincenzo Onorato, owner of Mascalzone Latino about the outcome of the case, we asked the opinion to Mrs. Alessandra Pandarese , who recently joined the Carnelutti Studio Legale Associato.
 
“The Court of Appeal judgment, in simple and essential terms, has saved the tradition of the Cup and set aside rules that were unacceptable; this was the primary purpose of this legal action, and has been achieved. In any event, I believe that the Cup has benefited from this: reaffirming the fundamental principle upon which the event is based may bring a healthy change; an exceptional sporting event pitting two giants of the sea against each other will keep everyone’s attention on the Cup. And this happens at a time when, realistically, it would not have been easy to find sufficient resources to adequately prepare a multi-challengers event”.

“As legal counsel, I assisted Mascalzone Latino by intervening in the legal action before the New York Court though an amicus brief, in support of BMW Oracle, sharing in full the rationale of the action brought against Alinghi and its plan to turn the America’s Cup into an event managed unilaterally by the defender, without reserving any role to the challengers”.
