America’s Cup, dichiarazione di Russell Coutts

[singlepic id=1282 w=300 h=204 float=left]America’s Cup – New York – Giunge il commento dello skipper di BMW Oracle Racing, Russell Coutts, in merito alla sentenza emessa oggi pomeriggio dal giudice Shirley Kornreich. Il togato statunitense ha dichiarato le regole fissate da Alinghi relativamente la misurazione della lunghezza al galleggiamento non conformi al Deed of Gift:

“Il nostro punto di vista che riteneva non includibile il timone nella misura della lunghezza al galleggiamento è stato ritenuto ammissibile dalla Corte Suprema dello Stato di New York. Accogliamo con soddisfazione questa decisione – ha affermato Coutts – Inoltre supportiamo l’iniziativa della Corte di risolvere le altre questioni in sospeso con la consulenza di tecnici che sono già stati giudici in America’s Cup e che potranno mettere la loro esperienza. Il giudice Kornreich hanno chiesto al Golden Gate Yacht Club e al defender, la Société Nautique de Genève, di nominare tre persone che dovranno presenziare all’udienza davanti alla Corte Suprema dello Stato di New York mercoledi prossimo, 4 novembre. Ciascuna delle parti ne sceglierà uno che, assieme, indicheranno il terzo.

Dalle loro testimonianze si cercherà di decidere su:
– l’uso di ballast per modificare la lunghezza al galleggiamento;
– se è sicuro regatare a Valencia nel febbraio 2010;
– se è possibile modificare le regole di regate e altri regolamenti dopo che sarà presentata la Notice of Race della 33ma America’s Cup;
– i tempi delle nomine dei componenti della Giuria Internazionale dell’America’s Cup;
– e se l’accordo sottoscritto tra l’ISAF e la Société Nautique de Genève lascia la giuria libera, indipendente e oggettiva.

Questi argomenti sono alla base della nostra richiesta principale: avere regole giuste e competitive”.

AMERICA’S CUP, RUSSEL COUTTS’ STATEMENT
[Golden Gate Yacht Club Press Release] “Our position that rudders should not be included in the Load Water-Line has been supported by the New York Supreme Court. We welcome this decision.

We also totally support the Court’s initiative to resolve the remaining issues with input from experts who are previous America’s Cup jurors and able to bring their experience to bear on sailing and technical matters.

Justice Kornreich has asked Golden Gate Yacht Club and the defender, Société Nautique de Geneve, to nominate three persons to attend a hearing of the New York Supreme Court next Wednesday, November 4. Each side will nominate one former juror who, in turn, will select the third.

Their combined testimony will help determine:
– the use of moveable water ballast in the measurement of LWL;
– whether it is safe to race off Valencia, Spain, in February 2010 (the date of the 33rd Match);
– whether racing and other rules can be changed after the Notice of Race is issued;
– the timing of the International Jury being empanelled for an America’s Cup Match;
– and whether the agreement between the International Sailing Federation and Société Nautique de Geneve leaves this Jury unencumbered to be independent and objective.

These issues go right to the heart of what we have advocated all along: fair rules and fair play.

This is a significant step towards getting the America’s Cup back on track”.
