America’s Cup – Ginevra – Dopo l’ennesima sentenza sfavorevole pronunciata dalla giustizia statunitense, Fred Meyer, vice commodoro della Société Nautique de Genève, ha rilasciato la seguente dichiarazione:
“La Société Nautique de Genève continua a studiare ogni opzione disponibile in vista dell’udienza del prossimo mercoledi. Speriamo che si giugna a una soluzione sugli argomenti ancora in discussione e che si possano avere certezze sulla 33ma America’s Cup”.
“Dispiace apprendere che il giudice Shirley Kornreich, dichiarando di non dover considerare i timoni come parte della lunghezza al galleggiamento, abbia assunto un’altra decisione che limita i diritti del defender sotto il Deed of Gift – ha aggiunto Fred Meyer – Il Deed of Gift Match voluto dal Golden Gate Yacht Club non è una regata basata sul mutuo consenso ed è governato in modo deciso dal Deed che indica: ‘Il tratto di mare dovrà essere scelto dal Club che difende la Coppa e le reate dovranno essere disputate sotto l’egida delle regole da questo stilate’. Ci aspettiamo che il giudice Kornreich riconosca i diritti e rispetti la posizione del defender”.

[Source Alinghi] “Société Nautique de Genève continues to evaluate its options ahead of next Wednesday’s hearing. We hope that the pending issues will be resolved and that we will have certainty regarding the 33rd America’s Cup”.
“It’s disappointing that Justice Kornreich took yet another unprecedented decision that diminishes the rights of the Defender under the Deed of Gift by considering that rudders are not part of the load waterline length measurement,” said Fred Meyer, adding: “The Deed of Gift Match chosen by Golden Gate Yacht Club is not a mutual consent match and is therefore ruled by the strict provisions of the Deed, which read: ‘These ocean courses […] shall be selected by the Club holding the Cup; and these races shall be sailed subject to its rules and sailing regulations […]’. We expect Justice Kornreich to recognise these rights and respect the Defender’s position”.
