“Il fatto che il giudice Kornreich abbia rigettato l’istanza di oltraggio alla corte presentata dal Golden Gate Yacht Club nei confronti dello yacht club Defender della 33ma America’s Cup, la Société Nautique de Genève, è senz’altro positivo ma non sorprendente, in quanto mancavano letteralmente le basi per un’azione legale di questo genere.
Il giudice Kornreich ha dimostrato di conoscere alla perfezione le carte processuali e tutto il caso e, se da una parte si è riservata di decidere su alcuni dei punti in discussione, dall’altra ha fatto definitivamente chiarezza sul fatto che il Deed of Gift non prevede alcuna restrizione nella progettazione delle barche. Il giudice ha anche chiesto ad entrambe le parti di ritornare a quella mediazione che il Golden Gate Yacht Club ha interrotto con questo nuovo tentativo di ricorso al tribunale.
Come sempre siamo pronti e disponibili a continuare a parlare con il Golden Gate Yacht Club e di lavorare per dare la necessaria chiarezza alla 33a America’s Cup, alle sue regole e alle procedure di stazza, sempre rigorosamente nell’ambito delle regole del Deed of Gift e di Société Nautique de Genève. Siamo inoltre assolutamente determinati a riportare l’evento in acqua e fuori dalle aule di giustizia una volta per tutte”.

[Alinghi Press Release] Brad Butterworth, Alinghi team skipper, gives a statement following today’s hearing before Justice Kornreich in the New York Supreme Court:
“It’s good that Justice Kornreich denied the Golden Gate Yacht Club’s request to hold the America’s Cup defending yacht club, Société Nautique de Genève, in contempt of court, but it doesn’t come as a surprise because there were no grounds for such an action.
Justice Kornreich showed a great deal of knowledge of the file and the case and while she reserved her decision, she made it crystal clear that the provisions of the Deed of Gift put no restriction on yacht design. She also asked both sides to return to the mediation that the Golden Gate Yacht Club halted with this new litigation attempt.
We are ready and willing to continue discussions with them and will work on providing clarity with regards the 33rd America’s Cup as far as rules and measurement procedures go; always within the framework of the Deed of Gift and Société Nautique de Genève’s rules. We are determined to get the competition on the water and out of the courtroom once and for all.”
