America’s Cup, dichiarazione di Brad Butterworth

Lo skipper di Alinghi replica con decisione al comunicato stampa e alla nuova azione legale promossa nella giornata di ieri da BMW Oracle Racing. Butterworth fa notare come le lettere inviate in data 26 maggio 2009 dalla Société Nautique de Genève al Golden Gate Yacht Club, contestate dagli statunitensi perché ritenute contrarie allo spirito del Deed of Gift, abbiano molti punti in comune con quelle scritte da Tom Ehman, allora alle dipendenze del San Diego Yacht Club, defender della Coppa nel 1987, al Mercury Bay Yacht Club, club da cui partì la sfida di Michael Fay:

“In merito a questo continuo ricorso al tribunale, vorrei ricordare che questa è la quarta volta che BMW Oracle Racing preferisce rivolgersi alla Corte piuttosto che sfidarci in acqua per la 33ma America’s Cup. Se leggete la sia lettera del 2 dicembre 1987 sia quella del 23 aprile 2009, scritte dai rispettivi defender e rivolte ai loro sfidanti, troverete diverse somiglianze perché i contenuti utilizzati nella lettera del 1987 sono gli stessi utilizzati dalla Société Nautique de Genève onde evitare ulteriori questioni, il che è particolarmente importante se si considera che l’autore della suddetta lettera, rivolta al Mercury Bay Yacht Club, era Tom Ehman attuale portavoce di BMW Oracle Racing. Tutto ciò che abbiamo fatto è conforme al Deed of Gift. Non bisogna dimenticare che il Deed of Gift riconosce al Defender dell’America’s Cup alcuni legittimi diritti. Invece di confondere le acque con litigi senza senso, BMW Oracle Racing dovrebbe fornire il Custom House Registry della barca il prima possibile come richiesto dal Deed of Gift e dalla Corte”.

AMERICA’S CUP, BRAD BUTTERWORTH RESPONDS TO BMW ORACLE RACING
[Source Alinghi] Statement from Brad Butterworth, skipper of Alinghi and four-time America’s Cup winner:

“The pending court case is the fourth time BMW Oracle Racing has chosen to go to court rather than meet us on the water and race for the 33rd America’s Cup. If you read the letters of the 2 December 1987 and the 23 April 2009 from the respective Defenders to their Challengers you will see similarities because the template of the 1987 letter was used by the Société Nautique de Genève to avoid doubt, particularly as the author of said letter to the Mercury Bay Yacht Club was Tom Ehman, who now represents BMW Oracle Racing. We are complying with the Deed of Gift in everything we do. Let’s not forget that the Deed gives the Defender of the America’s Cup some legitmate rights. Instead of diverting attention with groundless litigation, BMW Oracle Racing should provide their yacht’s Custom House Registry as soon as possible, as requested by Deed and Court.”
