America’s Cup, dichiarazione della Société Nautique de Genéve

America’s Cup – New York – Questa è la dichiarazione rilasciata oggi dalla Société Nautique de Genève dopo l’udienza che si è tenuta oggi presso la Suprema Corte di New York in merito alla tempistica di presentazione da parte del Golden Gate Yacht Club del Custom House Registry dell’imbarcazione sfidante alla 33a America’s Cup:

“Siamo soddisfatti che dopo quasi due anni di reticenze e di silenzi, l’avvocato del Golden Gate Yacht Club abbia finalmente dichiarato oggi in aula che l’imbarcazione sulla quale BMW Oracle naviga da quasi un anno negli Stati Uniti è USA, la barca sfidante per l’America’s Cup e che la stessa deve rispettare le dimensioni dichiarate dal Golden Gate Yacht Club nel suo atto di sfida. Il giudice si è riservato di emettere la sentenza circa la tempistica con cui il Golden Gate Yacht Club dovrà consegnare il Custom House Registry e siamo fiduciosi che la Corte seguirà le regole dettate dal Deed of Gift. E’ stato dunque fatto un primo passo avanti, ora, infatti, abbiamo qualche certezza in più circa l’imbarcazione del Golden Gate Yacht Club e speriamo di poterci concentrare sull’America’s Cup che è fissata per il Febbraio 2010 a Ras al-Khaimah – ha dichiarato Lucien Masmejan, capo dell’ufficio legale di Société Nautique de Genève – Come abbiamo sottolineato alla Corte, il nostro obiettivo è quello di organizzare una regata spettacolare e siamo a disposizione del Challenger per rispondere a qualsiasi domanda relativa alle procedure di stazza, in modo da poter avere tutti l’assoluta certezza che la barca americana corrisponda effettivamente alle misure dichiarate nell’atto di sfida. Vogliamo riportare l’America’s Cup in acqua e lontano dalle aule di giustizia” ha concluso lo stesso Masmejan.

[Golden Gate Yacht Club Press Release] Statement from the Société Nautique de Genève following today’s hearing regarding the timing of delivery of Golden Gate Yacht Club’s Custom’s House Registry for their challenging vessel for the 33rd America’s Cup:

“We are pleased that after almost two years of withholding the information, counsel for the Golden Gate Yacht Club disclosed in Court today that the boat BMW Oracle has been sailing for almost a year is USA, their America’s Cup challenging vessel. USA must match the dimensions listed in Golden Gate Yacht Club’s Certificate of Challenge. While the judge reserved her ruling on when the Golden Gate Yacht Club must issue the Custom’s House Registry, we are confident that the Court will uphold the Deed of Gift. We are pleased to have a further degree of certainty regarding the Golden Gate Yacht Club boat and we look forward to the 33rd America’s Cup in February 2010 in Ras al-Khaimah,” said Lucien Masmejan, lead counsel for the Société Nautique de Genève. “As we told the Court, our goal is to have an exciting race on the water and we are willing to assist the Challenger with any queries it has with regards the measurement procedures so that we and Golden Gate Yacht Club can be sure USA matches the dimensions in the Certificate of Challenge. We want to get the America’s Cup back to the water and out of the court,” he added.
