America’s Cup, BMW Oracle Racing cambia avvocati

BMW Oracle Racing, infatti, ha reso noto in serata di aver cambiato team legale, affidando l’incarico a David Boies e al suo studio Boies, Schiller & Flexner LLP. A darne notizia è stato il portavoce del sodalizio statunitense, Tom Ehman:

“Il Golden Gate Yacht Club e BMW Oracle Racing devono continuare a vigilare per assicurare che le regole e lo svolgimento della 33ma America’s Cup siano equi e conformi a quanto richiesto dal Deed of Gift. E’ grazie alla nostra vigilanza se noi – e non uno yacht club finto – siamo ora il Challenge of Record.

Continuano ad esserci seri problemi su come la Société Nautique de Genève sta conducendo la sua campagna come fiduciario del più antico trofeo nella storia dello sport, e nel modo in cui Alinghi sta organizzando la sua difesa dell’America’s Cup, a partire dal primo giorno quando tentarono di emanare delle regole che sono state da più parti bollate come “…le peggiori nella storia della Coppa America”, per arrivare alle recenti disposizioni relative alle procedure di stazza che, se confermate, potrebbero portare alla squalifica della nostra barca.

Ciò spiega perché l’avvocato David Boies e il suo studio Boies, Schiller & Flexner LLP si sono uniti al nostro team legale. La sua azione sarà mirata a proteggere i nostri interessi come partecipanti, gli interessi della vela e della Coppa stessa. La capacità, così come l’acume e la carriera dello studio Boies, Schiller & Flexner sono esemplari.

Restiamo comunque elettrizzati all’idea di regatare per la Coppa nel febbraio del 2010. Vogliamo che questo diventi il più grande evento nella storia della vela e continuiamo a lavorare affinchè questo accada, così come continuiamo a lottare per avere regole eque”.

[Golden Gate Yacht Club Press Release] Golden Gate Yacht Club and BMW Oracle Racing must remain vigilant to ensure that the rules and the running of the 33rd America’s Cup are fair and consistent with the Deed of Gift. It is because of our vigilance that we – and not a make-believe yacht club – are now the Challenger of Record.

There continue to be serious issues with the way Société Nautique de Genève is conducting their stewardship as Trustee of the oldest trophy in sports, and the way Alinghi have mounted their defense of the America’s Cup – from Day 1 when they tried to issue rules that were widely condemned as “the worst … in the history of the America’s Cup” to their recent issuance of measurement regulations that would disqualify our boat if left to stand.

That is why attorney David Boies and his firm Boies, Schiller & Flexner LLP have joined with our current legal team – to protect our competitive interests, the interests of sailing, and of the Cup itself. BSF’s reputation, legal acumen and track record are exemplary.

We remain excited about sailing for the 33rd America’s Cup in February 2010. We want this to be the greatest event ever in the history of sailing, and are continuing our preparations to make this happen – even as we continue our fight for fair rules.
