America’s Cup, Alinghi vs BMW Oracle Racing: una questione di certificato

[singlepic=729,300,204,,left]America’s Cup – New York – Venerdì mattina pubblicavamo la notizia della contromossa di Alinghi contro la causa mossa da BMW Oracle Racing relativamente alla data del Deed of Gift match. Il sistema automatizzato della Corte Suprema dello Stato di New York indicava in Disqualify Counsel – ovvero ricusazione dei legali della controparte, istituto possibile negli Stati Uniti – l’obiettivo dell’azione del sindacato svizzero.
Nelle ore successive, invece, più fonti ci hanno confermato che il brief depositato dal sindacato svizzero avrebbe per oggetto la mancata presentazione da parte di BMW Oracle Racing del customs-house registry, ovvero del certificato di stazza del multiscafo che, secondo il Deed of Gift, deve essere consegnato al defender “as soon as possible”, cioè quanto prima possibile.
Il certificato dovrebbe essere rilasciato dall’organismo nazionale preposto a gestire il registro delle unità da diporto e contiene tutti i dati tecnici della barca, oltre a una descrizione della stessa che viene resa riconoscibile mediante l’attribuzione di un numero di matricola.
L’errata dicitura riportata nel file relativo alla causa tra BMW Oracle Racing e Alinghi sarebbe quindi da imputarsi a una svista della cancelleria.

AMERICA’S CUP, ALINGHI VS BMW ORACLE RACING FOR THE CUSTOMS-HOUSE REGISTRY
America’s Cup – New York – Friday morning we published the news of the new Alinghi‘s move in the case against BMW Oracle Racing, that few days before filed a brief regarding the date of the Deed of Gift match. The automated system of New York State Supreme Court stated in Disqualify Counsel the object of the Swiss syndicate.
Hours later, however, several sources have confirmed that the brief filed by the Swiss syndicate would object to the absence of the BMW Oracle Racing‘s customs-house registry, that, under the Deed of Gift, must be given to the defender “as soon as possible”.
The certificate should be issued by the national body responsible for the register of pleasure craft and contains all the technical details of the boat, as well as a description of that which is made recognizable through the allocation of a number.
