America’s Cup – San Francisco – Solo domenica, rispondendo al comunicato Mito e Realtà di BMW Oracle Racing, Alinghi invitava i lettori a far riferimento a un’intervista rilasciata dallo skipper Brad Butterworth al noto mensile inglese Seahorse. Un invito raccolto dal management di BMW Oracle Racing che, a stretto giro, ha reso note le proprie osservazioni a riguardo.

BMW Oracle Racing: Sette team hanno definito quel documento il peggiore mai prodotto nella storia della Coppa America. Emirates Team New Zealand e Mascalzone Latino hanno continuato ad opporsi pubblicamente a quel Protocollo, definendolo come unilaterale. Il defender non ha mai chiarito il perchè di certe importante deroghe introdotte rispetto al regolamento della trentaduesima America’s Cup.
Brad Butterworth: “I giudici di regata sono scelti da una lista stilata da tutte le parti coinvolte”.
BMW Oracle Racing: Mentre questo era vero per la trentaduesima edizione, il Protocollo della trentatreesima Coppa America stabilisce che sia Alinghi a scegliere i giudici di regata. Questa dichiarazione di Butterworth è in contrasto con la precedente: “Quando vedranno chi abbiamo scelto, saranno tutti felici”.
Brad Butterworth: “Giudici e defender entrano molto raramente in relazione tra loro…”
BMW Oracle Racing: Brad confonde il Protocollo della XXXII America’s Cup con quello della XXXIII. Il nuovo Protocollo, infatti, prevede che Alinghi possa prendere parte alle regate di selezione degli sfidanti e possa quindi interagire con i giudici al pari dei challenger. Per la prima volta nella storia dell’evento è stabilito che sia il defender a decidere il formato e il calendario delle regate di selezione. In pratica, con questa nuova carta, i challenger non hanno più una loro serie di regate di selezione.
Brad Butterworth: “Abbiamo riconosciuto di aver commesso alcuni errori nella stesura del Protocollo. Ma li abbiamo corretti, lavorando con gli sfidanti che poi hanno sottoscritto il documento”.
BMW Oracle Racing: Almeno tre sindacati, Emirates Team New Zealand, Mascalzone Latino e BMW Oracle Racing non condividono la visione di Butterworth secondo la quale il defender avrebbe lavorato per correggere le deficienze del Protocollo. La realtà è che sette sindacati – Luna Rossa, Mascalzone Latino, Areva Challenge, United Internet Team Germany, Emirates Team New Zealand, BMW Oracle Racing e Victory Challenge – hanno definito questo Protocollo come il peggiore nella storia della Coppa America.
Mascalzone Latino ed Emirates Team New Zealand hanno continuato a contestare duramente il Protocollo. I neozelandesi hanno anche citato Alinghi in giudizio, accusandolo di condotta anti-sportiva. Il Protocollo, nonostante le revisioni, continua a garantire ad Alinghi quanto segue:
– il defender può cambiare il Protocollo a suo piacimento, tornando alla versione precedente;
– agli sfidanti non è concessa nessuna garanzia in merito alla nomina di giudici neutrali;
– al defender e ad AC Management non è fatto alcun obbligo di agire garantendo una manifestazione equa e sportivamente corretta;
– al defender è garantita la facoltà di squalificare chiunque contesti il Protocollo.
Brad Butterworth: “Il defeder prenderà parte alle challenger series in un’ottica di contenimento dei costi”.
BMW Oracle Racing: Non si capisce come questa cosa dovrebbe contribuire a contenere i costi. A parte questo, il fatto che il defender possa misurarsi con i challenger gli da enormi vantaggi. Nonostante sia già qualificato per la finale di Coppa America, il defender potrebbe eliminare un team, o influenzare l’esito della serie senza conseguenze per sé stesso.
Brad Butterworth: “La gestione del programma? Per ridurre i costi”.
BMW Oracle Racing: Con il Protocollo di Alinghi, il defender ha il potere di organizzare le regate di allenamento degli sfidanti, decidendo così dove e quando questi dovrebbero svolgere i loro test. Nessun altro sport permette al campione in carica di fare una cosa del genere. Il calendario delle regate deve essere stabilito da un entità super partes.
Brad Butterworth: “Abbiamo pensato a una campagna fatta con una sola barca, ancora una volta per favorire i challenger”.
BMW Oracle Racing: Il Protocollo prevedeva la costruzione di due barche, cosa che certamente Alinghi avrebbe fatto. Ma Alinghi ha cancellato la Common Declaration, che obbligava le parti ad annuncare quale barca avrebbero usato allo stesso tempo. Agli sfidanti era quandi richiesto di impiegare lo stesso scafo usato nel corso delle regate di qualificazione, mentre Alinghi poteva scegliere l’unità appena prima dell’inizio del match di Coppa America. Questo avrebbe rappresentato un vantaggio considerevole, in quanto il defender avrebbe potuto selezionare la barca sulla base delle previsioni meteo.
Brad Butterworth: “Nel corso della mia carriera, il fair play sui campi di regata è andato aumentando e ha toccato il suo picco a Valencia, dove le regate sono state molto combattute. Sarebbe lo stesso se potessimo godere ora di un’evento multi-challenger”.
BMW Oracle Racing: Perchè cambiare allora le resole in modo così radicale?
Brad Butterworth: “In maggio, la Deed of Gift Regatta sembrava una chiara possibilità. Ci siamo seduti, abbiamo parlato con loro, chiedendogli il tempo di poter costruire il nostro multiscafo. Hanno rifiutato”.
BMW Oracle Racing: Alinghi insiste sul fatto che fosse un suo diritto quello di fissare la data della sfida a due. Loro voleveno solo perdere temp e prendersi un vantaggio che il regolamento della Coppa non gli riconosce.
Brad Butterworth: “Comunque sia, una soluzione è sempre possibile e noi auspichiamo che si possa trovare”
BMW Oracle Racing: Brad non ha mai accettato gli inviti ai meeting con BMW Oracle Racing e Alinghi ha rifiutato le offerte di dieci mediatori. La nostra offerta è quella di tornare al protocollo della XXXII America’s Cup o a quello proposto dal challenger nel novembre del 2007.
Brad Butterworth: “Perchè le cose tornino a marciare, dobbiamo avere un Challenger of Record formalmente riconosciuto. Solo così potremo organizzare un evento vero e avere una Coppa ancor migliore rispetto alla precedente”.
BMW Oracle Racing: Perchè il defender non accetta la semplice proposta di tornare alle regole della trentaduesima America’s Cup? Appare evidente che il defender desideri che tutti si allineino sulla loro visione e sulle loro regole, garantendosi così un vantaggio e un controllo senza precedenti.

[singlepic=449,250,170,,left]In statement posted yesterday Alinghi cited an interview in this month’s Seahorse magazine with Brad Butterworth as setting out their views on many of the key issues surrounding the next America’s Cup. The following summary provides factual commentary on the points raised in that interview.
Brad Butterworth: “They bark on about a one-sided Protocol and unfair rules favouring the defender. I tell them once and for all that is not the case. And 12 challengers support this fact”.
BMW Oracle Racing: Seven teams said it was the worst protocol in the Cup’s history. Emirates Team New Zealand and Mascalzone Latino have continued to publicly oppose the protocol as grossly one-sided. The defender has never explained why it was necessary to make such a significant departure from the rules of AC 32.
Brad Butterworth: “The race officials are picked from a list given to the challenger and defender”.
BMW Oracle Racing: While this was true for AC 32, under the AC 33 protocol introduced by Alinghi the defender gets to select all officials. This most recent claim by Brad is at odds with his own earlier statement about the selection of officials that: “Once people see who we’ve selected they will be happy with them”.
Brad Butterworth: “The fact is the defender is the last to use the officials and so only rarely gets involved in picking them, as the challengers choose the best people through their elimination series”.
BMW Oracle Racing: Brad may be confusing the AC 32 protocol with AC 33. Under the AC 33 protocol Alinghi would also race in the challenger series and use the race officials at the same time as the challengers. Under Alinghi’s AC 33 protocol, the format and the schedule of all challenger racing is dictated by the defender for the first time in the history of the event. For the challengers in AC 33 it is therefore not “their” series any more as it was in all previous America’s Cups.
Brad Butterworth: “We have acknowledged that we are not without fault regarding the Protocol… but unlike our adversary, we have corrected these mistakes and have done that by working through the document with the challengers that have signed up”.
BMW Oracle Racing: At least three syndicates, Emirates Team New Zealand, Mascalzone Latino and BMW Oracle Racing, do not share Brad’s view that the defender has worked through the document and corrected the protocol’s serious deficiencies. The reality is that seven syndicates (Luna Rossa, Mascalzone Latino, Areva Challenge, United Internet Team Germany, Emirates Team New Zealand, BMW ORACLE Racing, Victory Challenge) all wrote calling it the worst protocol in the history of the event. Mascalzone Latino and Emirates Team New Zealand have continued to strongly and publicly oppose the protocol as one-sided. Emirates Team New Zealand is suing Alinghi for exercising anti-competitive control over the event.
Under the “new” protocol the following conditions still apply:
• The defender can change the protocol back at any time it wishes to the previous document
• Challengers gain no input on the appointment of neutral officials
• The defender and AC Management are pointedly excluded from any binding obligation to act in a manner that complies with fair dealing, good sportsmanship or fair play
• The defender can still disqualify any competitor who disputes the protocol.
Brad Butterworth: “The defender racing in the challenger series: this was is due to wanting to curb costs”.
BMW Oracle Racing: It is not clear that this would have saved costs. However under the new protocol the defender’s ability to sail in the challengers’ series gives it very considerable new advantages. As they are already guaranteed a place in the America’s Cup, the defender can eliminate a team or influence the outcome of the series at no risk to themselves.
Brad Butterworth: “A schedule of sailing: to curb costs”.
BMW Oracle Racing: Under Alinghi‘s protocol the defender gained the new power to organize the challengers’ practice race schedule. It would decide when challengers were allowed to race and who they could practice racing against. No other sport permits a defending champion to do this. The schedule should be set by an independent body.
Brad Butterworth: “We wanted to have a one-boat campaign, again to aid entries”.
BMW Oracle Racing: The protocol allowed all teams to build two boats, which Alinghi would almost certainly have done. But Alinghi rescinded the Common Declaration that required defender and challenger to name their race boat at the same time. This allowed the defender to wait until just prior to the America’s Cup match to choose their race boat while the challenger was required to race the boat it had qualified in. This conferred a huge advantage in being able to select a boat suited to the short term weather forecast.
Brad Butterworth: “Throughout my career, the fairness of the regatta has increased, peaking in Valencia where we saw the closest modern event ever. It would be the same if we had a multi-challenger event now”.
BMW Oracle Racing: Why then was there a need to radically change the rules to an unfair event?
Brad Butterworth: “In May and the one on one DoG match seemed a clear possibility we sat down with them to try to agree a date for a fair regatta, giving us time to build our multihull, but they refused”.
BMW Oracle Racing: Alinghi insisted that they be given the challenger’s right to set the race date. They wanted to delay the event to gain more time and an advantage outside the rules of the Cup.
Brad Butterworth: “However we are still open to discussion and very much welcome a resolution to this dispute”.
BMW Oracle Racing: Brad has never accepted any invitation to meet with BMW Oracle Racing, and Alinghi have declined ten offers of mediators. BMW Oracle Racing have offered (and the offer still exists today) to return to an AC 32 protocol or the rules proposed by the challengers in November 2007.
Brad Butterworth: “To move things on we need to have a Challenger of Record firmly installed so that we can organize an event with the challengers and have a Cup similar to the one we had last time or even better”
BMW Oracle Racing: Why then doesn’t the defender simply accept the reasonable proposal to return to rules like AC 32? It appears that instead the defender wishes to issue all rules on their terms to create an unprecedented level of control and advantage.
