America’s Cup, nuove accuse tra Société Nautique de Genève e Golden Gate Yacht Club

[singlepic id=4338 w=204 h=300 float=left]America’s Cup – New York – I legali della Société Nautique de Genève sarebbero entrati in possesso di prove che dimostrerebbero come il Golden Gate Yacht Club abbia fornito dichiarazioni fuorvianti davanti alla Guardia Costiera degli Stati Uniti e abbia omesso di comunicare al giudice Shirley Kornreich alcune significative informazioni relative al rilascio del Custom House Registry di USA, il trimarano con il quale BMW Oracle Racing sfiderà Alinghi nell’ambito della 33ma America’s Cup.
Il defender, infatti, ha ottenuto copia dei documenti presentati alla Guardia Costiera statunitense dal Golden Gate Yacht Club e ha scoperto che il sodalizio americano aveva fatto richiesta di procedura d’urgenza in vista del trasferimento della barca negli Emirati Arabi Uniti, trasferimento che, stando a quanto dichiarato, sarebbe dovuto iniziare attorno al 25 settembre. Dalle successive mosse legali intraprese dal team di Larry Ellison appare evidente che non vi era intenzione alcuna di spostare la barca nei tempi indicati.
Inoltre, la richiesta sarebbe stata avanzata il 12 giugno, ben prima dell’udienza dello scorso 10 agosto, quando il Golden Gate Yachlt Club ha presentato un affidavit con il quale si sosteneva di non poter presentare la documentazione richiesta a causa di modifiche che dovevano essere completate prima di poter procedere con le operazioni di stazza.

[Source Alinghi] Société Nautique de Genève’s legal counsel has brought recently discovered information concerning Golden Gate Yacht Club’s Certificate of Documentation, previously known as the Custom House Registry, to Justice Kornreich’s attention.
The America’s Cup Defender obtained the documents submitted to the US Coast Guard by Golden Gate Yacht Club to obtain the Certificate of Documentation through the Freedom of Information Act and discovered that Golden Gate Yacht Club had asked for priority treatment as it wanted to ship its boat to the United Arab Emirates on 25 September.
It has also been revealed that the Challenger withheld information at the 10 August hearing concerning their Certificate of Documentation; the Golden Gate Yacht Club had obtained a tonnage certificate nearly two months prior to the hearing and didn’t disclose its existence to Justice Kornreich or the Société Nautique de Genève in court.
