America’s Cup, Mascalzone Latino risponde all’AC Management

[singlepic=1026,250,170,,left] America’s Cup – Milano – Alessandra Pandarese, General Counsel di Mascalzone Latino, risponde alla richiesta di ulteriore documentazione relativa al Reale Yacht Club Canottieri Savoia avanzata da AC Management e Alinghi.
“Il Reale Yacht Club Canottieri Savoia e Mascalzone Latino mi hanno incaricata di rispondere alle Vostre recenti email con le quali chiedete ulteriori documenti riguardanti la costituzione dello Yacht Club (Certificato di avvenuta costituzione, certificato del registro delle imprese, e documento di affiliazione alla Federazione Italiana Vela) al fine di ‘convalidare’ la sfida.
Tale richiesta, avanzata ben un anno dopo l’iscrizione alla 33ma America’s Cup, è illegittima ed arbitraria.
Il R.Y.C.C.S. con il Team hanno soddisfatto i requisiti necessari all’iscrizione alla 33ma America’s Cup sin dal 20 novembre 2007, presentando copia ‘autentica e certificata’ dell’Atto Costitutivo dello Yacht Club, lo statuto ed i documenti riguardanti la sua attività agonistica, come richiesto dal Notice of Entry. Inoltre, ci preme ricordare che questa sfida è tra le poche ad aver pagato la quota d’iscrizione assieme al deposito del ‘Notice of Entry’ (è di pubblico dominio che alcuni degli altri team iscritti nel 2007 sono stati esonerati dal pagamento di tale tassa di iscrizione).
Inoltre, è noto a tutti, che il Reale Yacht Club Canottieri Savoia è tra i club più attivi e conosciuti tanto a livello nazionale, quanto a livello internazionale, ed è organizzatore di regate prestigiose e, come ben sapete, ha preso parte a due campagne di Coppa America. E’ uno Yacht Club che, fondato nel 1893, vanta più di un secolo di storia.
Il R.Y.C.C.S. è regolarmente iscritto alla 33ma America’s Cup, come del resto confermato dalla corrispondenza proveniente da A.C. Management e Alinghi. Inoltre oggi, finalmente, il team risulta essere inserito anche nella lista ufficiale degli iscritti, pubblicata sul sito web dell’America’s Cup.
Il R.Y.C.C.S./Mascalzone Latino è quindi tra i challenger accettati della 33ma America’s Cup, ed al pari degli altri sfidanti, unicamente sotto – condizione all’esito della causa pendente avanti alla Corte di Appello dello Stato di New York.
La procedura di ‘convalida’ è totalmente priva di fondamento. Una tale procedura non è nemmeno prevista dalle regole in vigore. La richiesta di tale documentazione relativa ad uno Yacht Club costituito da più di un secolo e pienamente operativo è, quindi , da considerarsi infondata e discriminatoria.
Inoltre, questa richiesta ritarda senza ragione la procedura promossa dal nostro team per ottenere i benefici fiscali concessi ai challengers dalle autorità spagnole, ai sensi del Regio Decreto nr. 1893/2008, che potrà essere completata solo in seguito alla presentazione della vostra lettera attestante la nostra iscrizione.
Riteniamo di aver espresso la posizione del R.Y.C.C.S. e vi invitiamo pertanto ad inoltrarci la lettera relativa all’iscrizione, che le autorità spagnole ci hanno chiesto.

America’s Cup – Milan – Mascalzone Latino‘s General Counsel Alessandra Pandarese answers to AC Management’s e-mail in which the America’s Cup’s organization asks more documents regarding Reale Yacht Club Canottieri Savoia establishment.
“Reale Yacht Club Canottieri Savoia and Mascalzone Latino asked me to reply to your recent e-mails in which you have requested further documents concerning the establishment of the Yacht Club (Certification of Incorporation, Trade Association registry act, affiliation to Federazione Italiana Vela) in order to “validate” their challenge Entry.
This request, which is made more then a year later from the registration to the America’s Cup 33rd , is illegitimate and arbitrary.
RYCCS and the team have fulfilled the requirements to entry into 33rd America’s Cup since November 20th, 2007. This included the “notarized and certified” copy of Yacht Club incorporation, the by laws , and documents concerning its regattas, as required by the Notice of Entry. In addition, we remind you that this challenge is among the few that has paid the entry fee accompanying the Notice of Entry (It has been in fact public that some of the other teams entered in 2007 were relieved from paying such fee).
Further it is public knowledge that Reale Yacht Club Canottieri Savoia is amongst the most well known and active yacht clubs nationally and internationally, organizer of prestigious regattas and with two America’s Cup participations, as you are well aware. This Yacht Club has its origin back into 1893 with more then a century’s history.
RYCCS is a duly registered 33rd America’s Cup challenge, as also recognised by a number of correspondence from ACM and Alinghi team. Now the team is also, finally, listed in the America’s Cup web site. RYCCS/Mascalzone Latino is among the 33rd America’s Cup accepted challengers, only subject, as well as the others, to the outcome of the New York State Court of Appeals’ decision.
There is no basis for a “validation” procedure, which is not even set forth within the current rules. It is therefore groundless and discriminatory to enquire for further documentation of a Yacht Club which is well established and operative.
In addition this enquiry is unduly delaying the procedure for obtaining the fiscal benefits by the Spanish authority, in accordance with the Royal Decree n°1893/2008, which procedure could only be completed by receiving a letter from you certifying the challenge registration.
We trust that the position of RYCCS is clarified and please forward us the due letter of registration which the Spanish Authorities are requiring.
