America’s Cup, il Circolo Vela Gargnano scrive al Golden Gate Yacht Club

[singlepic id=3434 w=204 h=300 float=left]America’s Cup – Gargnano – Nel giorno in cui la Société Nautique de Genève e il Golden Gate Yacht Club si preparano a tornare davanti al giudice Kornreich, chiamato a decidere in merito all’ultimo scambio incrociato di accuse – da un lato la presenza di un motore a bordo di Alinghi 5 e di un accordo segreto tra Alinbghi e l’ISAF, dall’altro la mancata consegna del Custom House Registry – il Circolo Vela Gargnano, per mano del suo presidente, Lorenzo Rizzardi, torna a scrivere al club statunitense:
“Caro Commodoro Young,
sono a scriverti nuovamente dopo le ultime lettere.
Abbiamo appreso che il Golden Gate Yacht Club ha chiesto nuovamente ad Alinghi di rispettare le regole fisse dal Deed of Gift.
Sebbene ci dispiaccia notare che il futuro dell’America’s Cup sembri ancora una voltra dipendere dalla cause legali, restiamo confidenti che, nel rispetto del vostro ruolo fiduciario di Challenge of Rercord, vi impegnerete per tornare in acqua per riportare la Coppa America al suo elemento naturale.
Come Challenge of Record, infatti, avete contribuito a rendere la 32ma edizione della Coppa America un evento miliare nella storia della competizione e avete confermato l’impegno del Golden Gate Yacht Club verso un evento multi challenge.
Alla luce di tutto ciòvogliamo riportare la vostra attenzione sulla nostra richiesta di prendere parte alle Challenger Selection Series della 33ma America’s Cup, come già indicato nella nostre lettere del 22 maggio e del 27 maggio 2009.
Tutte le condizioni e i requisiti che avevate posto sono stati ora ampiamente soddisfatti e, vista la mancanza di una vostra risposta, possiamo ragionevolmente dedurre che condividiate questa opinione.
Ci aspettiamo pertanto una risposta da parte vostra che confermi quanto riportato nelle vostre precedenti dichiarazioni in favore di un evento multi challenge (come tra l’altro ripetuto davanti alla Corte nell’udienza dello scorso 14 maggio) e che si possa proseguire in tale direzione senza ulteriori ritardi.
Sono sicuro che apprezzerete la nostra pazienza nell’aspettare per ben due mesi prima di iniziare una discussione formale con voi e il fatto che ci siamo resi disponibili a viaggiare sino alla vostra sede per incontrarvi secondo le vostre necessità.
L’attuale stallo ha generato grande incertezza e più tempo trascorrerà senza una decisione da parte vostra, più ci renderà difficile organizzare una sfida competitiva.
Nonostante ciò siamo a chiedervi ancora una volta formalmente di incontrarci senza ulteriori ritardi per poter lavorare all’organizzazione delle Challengere Selection Series. A tal proposito ci preme sottolineare che Francesco De Leo, amministratore delegato di Green Comm Challenge, sarà sulla West Coast tra il 26 luglio e il 27 agosto.
Di fatto, ci aspettiamo che il 21 luglio, nel corso dell’udienza, affronterete anche questi argomenti mentre chiarirete la vostra posizione nel confronto vis-a-vis con la Société Nautique de Genève (che ci legge per conoscenza).

CIRCOLO VELA GARGNANO WRITES TO GOLDEN GATE YACHT CLUB
America’s Cup – Gargnano – Circolo Vela Gargnano, Green Comm Challenge yacht club, write again to Golden Gate Yacht Club:
“Dear Commodore Young,
I am writing further to our latest correspondence.
We understand that GGYC has again requested the Court to address the issue of Alinghi’s compliance to the rules of the Deed of Gift.
Although we do regret that the America’s Cup future seems to be once again dependent on a legal dispute, we remain confident that, in your fiduciary role as the Challenge of Record, you will commit to go back in the water to return the America’s Cup to its original intent.
You have actually greatly contributed as a Challenger of Record to the 32nd Americas’ Cup to as to make that event the milestone in the history of the competition and you have subsequently consistently committed the GGYC to be open to a multi challenge event.
In the light of the above we wish once again to bring your attention to our request to take part to a Challengers’ Selection Series in relation to 33rd America’s Cup, as we have already indicated in our letters of May 22 and May 27, 2009.
All the conditions and pre-requisites which you have indicated, have now actually been duly filled and occurred, and from the lack of your reply, we can only reasonably assume that you share this opinion.
We do therefore expect you to follow up with your previous statements in favour of a multi challenge event (statements that have also been repeated in Court at the hearing of May 14, 2009) and proceed accordingly without any further delay.
As I am sure, you will appreciate we have already been uselessly waiting for more than two months to engage in a formal discussion with you and we have even made ourselves available to travel to the Bay area to meet you at your convenience.
The present standstill has already created a status of uncertainty and the more time elapses without action on your side, the more difficult it will make it for us to build up a truly competitive challenge.
Therefore we wish formally to request you once again to meet without further delay and to start working on a Challengers’ Selection Series project. On this regard we wish to let you know that Francesco De Leo, Executive Chairman of Green Comm Challenge, will be in the West Coast from July 26th through August 27th.
As a matter of fact, we expect that on July 21, when attending the Court hearing, you will be addressing this issue as well, while sorting out your position vis-à-vis Société Nautique de Genève (to whom we are sending copy of this letter for their information).
